Prohibited and restricted items policy

Before listing your item, make sure we allow it on OZROLO, and find out if we have specific rules and conditions on how you should list it. Check the list of prohibited and restricted items below. You also need to make sure that the sale of your item complies with all laws in Australia.

Make sure your listings and products follow these guidelines. If they don’t, they may be removed, and you may be subject to a range of other actions, including restrictions of your selling privileges and suspension of your account.

Understanding the rules

Our policies are often based on Australian laws, although in some cases, we may also base our policies on input from our members and our own discretion, especially for dangerous or sensitive items.

Read and understand our policies before listing items. Follow our guidelines and review our examples so you know beforehand what you can and can’t sell on OZROLO.

When selling internationally, certain items may be legal to sell in Australia, they might be illegal elsewhere.

The list of prohibited and restricted items below covers items you can list under certain conditions, and items that we don’t allow at all.

Prohibited and restricted items

Adult items

Sexually oriented adult material is not allowed. This includes the following:

      1. Films and video games classified as RC (refused classification), X or created for an adult audience
      2. Sexually explicit anime, comics, books, films, animation, manga, hentai, yaoi
      3. Adult magazines, nudist publications, or adult anime/manga that include sexually-explicit content, nudity, or sexual stories
        1. The following magazines and books can be listed as long as the listing and product don’t contain nude images or explicit content: Playboy, Playgirl, Mayfair, and Penthouse
      4. Listings containing nudity (other than nude art)

OZROLO defines nudity as male/female genitalia, anus, or female breasts where the areola or nipple is visible

Sex toys and sex accessories may be listed in the Sexual Wellness category following these guidelines:

      • The Sex Toys and Fantasy, Fetish & Accessories categories are restricted to pre-approved sellers. To apply for approval, please contact us. Let us know you’d like to be approved to list in restricted sexual wellness categories, and we will be in contact with you.
      • Items must be new and in the original packaging
      • Listings must not include images of nudity or sexual content

Nude art listings must include the item specifics attribute Subject:Nudes, and can only be listed in the Art categories, or the following Collectables category:

Art > Photographs

Alcohol

Wine and other alcoholic beverages are only allowed by pre-approved sellers who hold a valid liquor license. Buyers must be over 18 years of age.

Most alcohol products may be sold on OZROLO.com.au. However, there are different state laws on trading alcohol (see our Links below for relevant legislation from each state) and it is up to the seller to ensure that they are meeting all legal requirements, including holding the correct liquor licences.

      • The sale of alcohol products is restricted to pre-approved sellers, who must:
        • Hold the required liquor licence(s) and display their applicable licence number(s) in the listing
        • Ensure their listings and products comply with the Alcohol Beverages Advertising Code (ABAC)
        • Select a delivery service with age verification upon delivery
        • Not sell to customers located in dry zones
        • Include this disclaimer in their description verbatim:
          Buyers must be at least 18 years old and located outside a designated dry zone to purchase alcohol.
      • Collectable alcohol containers may be sold but must be empty.
      • The sale of stills for the distillation of alcohol is subject to the following requirements:
        • Stills over five litres capacity cannot be bought, sold or possessed without permission from the Australian Taxation Office
      • Regardless of the size of the still used, distillation of alcohol at home without an excise licence is illegal.
      • To apply for approval to list in the Alcohol category, please contact us. Be ready to provide your eBay username, your liquor licence number(s), Australian Business Number (ABN) or Australian Company Number (ACN), registered business name and website. Approval to list in the category will be at eBay’s discretion.

Additional information

Some areas in Australia are considered ‘dry zones’. A dry zone is an area where the consumption of alcohol is restricted or prohibited. OZROLO may block a transaction if a buyer is located in a dry zone and sellers must not sell to customers located in dry zones.

Animals and wildlife products

Pets and other live animals, mounted specimens and ivory cannot be sold on OZROLO.

Art

You can sell your original artwork and other artwork that you’re authorised to resell on OZROLO.

This policy outlines restrictions related to the sale of many kinds of artwork. For example, the policy gives guidance on how to handle sales of items such as:

      • Reproductions – You can sell reproductions, like posters or exact replica paintings, if it doesn’t violate laws, copyrights, or trademarks
      • Exact replica paintings – You have to clearly state it’s a reproduction in the listing title and description
      • Other artists’ work – You may include the artist’s name in the title if the work is actually by the artist or is an exact replica of the artist’s work
      • Art with alterations, conservation, or repairs – Your listing description should provide details of exactly what work was done

We encourage the lawful sale of art on OZROLO and we have worked with members of the art community on OZROLO as well as various third-party organisations serving the industry to develop a code of conduct for selling works of art on the site.

When selling art on OZROLO, you must abide by all laws relating to the sales of works of art and assist in the prosecution of violators of the law in this respect.

When buying or selling indigenous art, we encourage you to review the Indigenous Art Code to learn more about ethical trading practices.

Make sure your listing follows these guidelines. If it doesn’t, it may be removed, and you may be subject to a range of other actions, including restrictions of your buying and selling privileges and suspension of your account.

The following guidelines have been drawn from specific terms of sale that are considered “general trade practice” within the organised art community. It neither replaces nor supplants OZROLO User Agreement(insert OZROLO user agreement) , but rather, supplements those policies.

Sellers are encouraged to abide by these guidelines when selling works of art on eBay:

Allowed

      • · Selling your own original artwork.
      • · Selling artwork that you are authorised to resell.

Restricted

· You may only sell a reproduction (in the form of a poster, print or exact replica painting) if it does not violate any applicable laws, copyrights or trademarks.

· When listing an exact replica painting:

· The words “reproduction” or “repro” must be included in the title.

· The item description must clearly state that the work is a reproduction.

· You may include the artist’s name in the title of the listing only when listing a work by the artist him/herself or an exact replica of the artist’s work. You may not include the artist’s name when listing a work done “in the style of” an artist.

· If any alterations, conservation or repairs have been performed on the work of art, you must disclose this information in a clear and prominent manner within the item description.

Not allowed

· Knowingly selling, exhibiting, trading, producing or advertising any unauthorised copy or reproduction of any work of art.

· Disclaiming knowledge of, or responsibility for, the authenticity or legality of an item that you describe as genuine.

· Describing or marketing any item as genuine if you cannot provide reasonable evidence to prove its authenticity.

· Knowingly participating in any way in the advertisement or sale of any work of art using any deceptive practices, including, but not limited to, false or misleading claims of the item’s scarcity, value, provenance, condition or investment potential.

Artefacts, cultural heritage, and grave-related items

As there are laws and regulations around the sale of artefacts, fossils, relics, and cave formations, it’s important that listings follow our policy guidelines.

Artefacts and cave formations can have significant cultural value and may be legally protected.

      • Items obtained from government or protected land, historical grave sites, or shipwrecks, can’t be sold on OZROLO
      • Listings for artefacts, fossils and relics must:
        • Follow all government regulations
        • Be authentic and listed in the appropriate category
      • Listings for replicas must:
        • State the item is a replica in the title and description
        • Be listed in the Reproduction or Fantasy category, as appropriate
      • Listings for antiquities must include the provenance or ownership history of the item and, where possible, a photo or scanned image of an official document including both the item’s country of origin, and the legal details of the sale. The item must also be approved for import or export
      • Looted or stolen goods can’t be sold on eBay
      • For more information on the categories of cultural goods most vulnerable to illicit activity, please see the International Council of Museums’ Red List
      • Listings for Australian cultural heritage items must follow all government regulations
      • Relics from historic shipwrecks may be listed within Australia, provided the seller has obtained the appropriate permit, and displays a copy of it in their listing. (Note: The buyer is also obliged to submit a notification of their purchase within 30 days)
      • Class A protected objects on the National Cultural Heritage Control List can’t be exported from Australia. Listings for items which are otherwise allowed under this policy may not offer international postage
      • Listings for Class B protected objects on the National Cultural Heritage Control List, which are otherwise allowed under this policy, must include the relevant export permit if international postage is offered
      • Items considered sacred by Aboriginal or Torres Strait Islander persons can’t be sold on eBay

Additional information

The information on this page can help assist sellers trade lawfully on OZROLO. OZROLO cannot assess specific artefacts, or whether their sale is lawful. Sellers are responsible for ensuring that their transactions are lawful.

A brief summary of the relevant legislation is outlined below. For any questions regarding the right to sell an artefact, either within Australia or overseas, we recommend sellers either contact the relevant government department and/or consult with a lawyer.

Protection of Movable Cultural Heritage (PMCH) Act 1986

Cultural property – objects that people create or collect – forms an important part of a nation’s identity and can be artistic, technological, historical or natural in origin. National and international cultural property is protected in Australia and administered by the Department of Communications and the Arts.

The National Cultural Heritage Control List sets out whether certain objects may be exported:

      • Class A protected objects can’t be exported from Australia. Examples include, but are not limited to:
        • Victoria Cross medals awarded to Australian service personnel
        • Significant items of Aboriginal and Torres Strait Islander heritage, such as rock art and ritual objects
      • Class B protected objects require a permit to be exported. Examples include, but are not limited to:
        • Coins and other artefacts from historic shipwrecks
        • Items of Aboriginal or Torres Strait Islander heritage
        • Archaeological objects
        • Natural science objects such as meteor fragments

Historic Shipwrecks Act 1976

Under the Historic Shipwrecks Act 1976, it is illegal to disturb or remove items from historic shipwrecks without a permit. However, the law does provide ways in which dealers and collectors can legally purchase or sell coins and other relics or artefacts. Aboriginal and Torres Strait Islander Heritage Protection Act 1984

The Aboriginal and Torres Strait Islander Heritage Protection Act 1984 (ATSIHP Act) can protect areas and objects that are of particular significance to Aboriginal people. The ATSIHP Act allows the Environment Minister, on the application of an Aboriginal person or group of persons, to make a declaration to protect an area, object, or class of objects, from a threat of injury or desecration.

Clothing, used

Used clothing are not allowed to be sold on OZROLO.

Contracts

When you list an item that comes with a contract, you’re responsible for following the rules of that contract. Since OZROLO isn’t a party to these types of contracts, we don’t review contracts, adjudicate or take sides in any contract disputes. OZROLO also doesn’t search for items that may raise these types of issues or enforce terms from third parties restricting the resale of an item.

Please bear in mind that listing or selling items in violation of your contractual obligations could put you at risk of legal liability. Before listing an item, we recommend that you review any relevant contracts or agreements to ensure you can legally sell it on OZROLO. You are responsible for ensuring that your transaction is lawful.

If you have any questions about your rights or obligations under a contract or agreement, get in touch with the company with whom you have the contract or talk to a lawyer for advice.

Cosmetics, used

Listings for used cosmetics, cosmectic brushes, sponges, or applicators are not allowed. This includes products such as skin moisturisers, sunscreens, perfumes, lipsticks, fingernail polishes, eye and facial makeup preparations, shampoos, permanent waves, hair colours, toothpastes, and deodorants

    • Cosmetics, colognes, perfumes, and lotions must come in the original container
    • Homemade cosmetics must comply with government regulations

Counterfeit currency and stamps

OZROLO does not allow the trading of raw or graded currency.

Credit cards

The sale of credit cards, debit cards, and money orders is restricted or not allowed on OZROLO.

Currency and coins

OZROLO does not allow the trading of raw or graded currency.

Drugs and drug paraphernalia

Illegal drugs, drug paraphernalia, and drug-like substances are not allowed.

The following items are not allowed to be listed on OZROLO:

      • Narcotics, steroids and other controlled substances (including any substance listed in Schedules 2 & 3 of the Commonwealth Crimes (Traffic in Narcotic Drugs and Psychotropic Substances) Act 1990)
      • Items that claim to provide a “legal high”
      • Pipes, or any item marketed as for use with marijuana or illegal drugs
      • Tobacco pipes, and other smoking accessories not intended for drug use, are allowed
      • Vaporizers intended to be used with alcohol, marijuana, or illegal substances

Electrical and electronic equipment

The following types of electronic equipment are not allowed:

      • Radar detectors
      • American FRS/GMRS radio equipment
      • CB Amplifiers
      • Cell phone, GPS radar and other signal jamming devices
      • Telecommunications numbers
      • Mobile Phone unlocking codes

Cameras, recorders, or other similar devices can be listed as long as the description doesn’t encourage their use for illegal purposes.

The following items may only be sold in accordance with applicable regulations:

      • Scanners
      • Transmitters
      • CB radios
      • Amateur radio equipment
      • Low interference potential devices
      • Telecommunication products
      • Mobile phone repeaters
      • Mobile phone booster amplifiers
      • High powered cordless phones

Embargoed goods and prohibited countries

Sellers can’t list embargoed goods or pre-embargoed goods from these countries or regions:

      • Cuba
      • Crimea region of Ukraine (as defined under applicable sanctions)
      • Democratic People’s Republic of Korea (North Korea)
      • Iran
      • Syria

Event tickets

Sale of event tickets are not permitted on OZROLO.

Firearms and accessories

The following are not allowed:

      • Firearms of any type
      • Parts and accessories for assault weapons, including blueprints and instructions
      • Any part or accessory in violation of local law
      • Firearm receivers, even if incomplete
      • Ammunition for firearms, including bullets, cartridges, casings, shells, and hulls
      • The following firearm accessories are not allowed:
        • Gun parts, including, but not limited to, barrels, firing pins, trigger assemblies, and magazines

Firearm accessories that we allow, such as grips, holsters, and scopes, must follow these guidelines:

      • The listing must clearly identify the part or accessory being sold as well as the type of firearm it fits (“type” can mean general use and not necessarily brand or manufacturer). For example, “This part can be used with bolt-action rifles.”
      • The listing cannot show a picture of an actual firearm

Food

The following and similar food items are not allowed:

      • Unpasteurised dairy products (except cheese that follows government guidelines)
      • Unpasteurised fruit or vegetable juice
      • Wild mushroom (except for morel and shitake mushrooms)
      • Ackee fruit or seeds
      • Expired food
      • Government assistance benefits that can be used for food
      • Food items that are subject to recall by FSANZ

 

When listing food items that are allowed, sellers must:

      • Ensure food items are properly packaged and stored safely
      • Clearly state the expiration date in the item description
      • State how perishable items will be delivered, and ensure they are delivered to the buyer before the expiration date

Gaming machines (slot or poker machines)

      • Any gaming or an amusement device that involves a game of chance are not allowed
      • Gambling machines/devices capable of paying out money or tokens or registering an amount of money to be paid, regardless of age or ability to function, can’t be listed
      • Gambling machine parts (e.g. cabinets, circuit boards, the “wheels” with the pictures, signs, etc.) are not allowed

Gift cards

OZROLO does not permit the sale of gift cards.

Government documents, IDs and licences

The following or similar items are not allowed:

      • Government, private transit, or shipping company uniforms and accessories such as hats, pins and scarves
        • Vintage or collectible uniforms and accessories may be listed if they meet all these requirements:
          • The item is 10 years old or older
          • It’s no longer in use
          • It doesn’t look like a current uniform or accessory
      • Government, transit or shipping company property such as vehicles, license plates, keys for vehicles, mail bags, company decals and transit documents
      • Fake documents, government-issued documents or official certificates or diplomas
      • Government-issued IDs, passports, birth certificates or license plates
        • Collectible license plates are allowed as long as they are expired and at least 3 years old or as allowed by law
      • Government-issued medals and certificates for medals
      • Vehicle Identification Number (VIN) plates or rivets
      • Signs and similar items for rideshare services

Hazardous, restricted or regulated materials

The following are not allowed:

      • Poisons and carcinogenic substances
      • Dinitrophenol (DNP) in any of its forms, either as a pure substance or active ingredient of any product (such as weight-loss supplements)
      • Fire extinguishers that contain carbon tetrachloride
      • Non-government-approved refrigerants
      • Radioactive materials
      • Combustible materials like black powder, caps for toy guns, explosive fuses, fireworks, exploding targets, flares, flash paper, red phosphorous, gasoline, Thermite
      • Explosives precursors including aluminium powder, ammonium nitrate, calcium ammonium nitrate, calcium nitrate, hydrogen peroxide above 12% weight by weight (carbamide peroxide above 34% by weight), magnesium nitrate hexahydrate, magnesium powder, nitric acid, nitromethane, nitro-fuel, potassium chlorate, potassium nitrate, potassium perchlorate, sodium azide, sodium chlorate, sodium nitrate, sodium perchlorate, sulphuric acid and urea nitrate
      • Hazardous materials banned by a selected delivery provider (Sellers should check with them before listing an item)

The following are restricted:

      • If the material can be sent by standard postage services and is not prohibited by local laws or regulations, then it can be listed
      • If hazardous materials have specific postage restrictions required by the delivery provider, these must be outlined in the item description

WELS Products

The Water Efficiency Labelling and Standards Act 2005 (WELS Act) is Australia’s water efficiency labelling scheme that requires certain products to be registered and labelled with their water efficiency in accordance with the standard set under this regulation.

The WELS Act requires that all new WELS products (such as showers, tap and toilet equipment, clothes washing machines and dishwashers) be supplied as they are registered, and the water efficiency information be displayed in the listing. See the Water Efficiency Labelling and Standards (WELS) scheme website for more details and to check registrations.

If you supply or sell WELS products, you need to ensure that the products:

      • Are registered with the WELS Regulator and the product has a correct WELS label in accordance with section 20 of the WELS Act; and
      • Have their labels or water rating information remain fully visible on or adjacent to products while they are offered for sale

In order to list WELS products on eBay, sellers must meet the requirements of the WELS Act.

GEMS Products

Australia’s Greenhouse and Energy Minimum Standards Act 2012 (GEMS Act) sets registration, minimum energy performance standards (MEPS) and energy labelling requirements for a range of appliances and equipment such as televisions, dishwashers, certain lighting products, three-phase electric motors and computers. The Energy Rating website contains a full list of regulated products and their specific requirements.

Under the GEMS Act, all models covered by the regulation must be registered prior to being supplied. Further information on the registration process is available on the Energy Rating website.

Products that do not meet these requirements cannot be supplied in Australia. Please note that the GEMS Act contains a range of penalties for non-compliance.

Additionally, some products – for example, some incandescent tungsten filament lamps (light bulbs) – are also covered by Customs import prohibitions and cannot be imported into Australia without written permission granted by the relevant Minister or an authorised officer.

GEMS products may be listed on eBay, provided they meet the requirements of the GEMS Act.

Some incandescent tungsten filament GLS lamps are subject to an import restriction. They must not be imported into Australia without written permission from the relevant Minister.

Emissions-controlled products

The Product Emissions Standards Act 2017 and the Product Emissions Standards Rules 2017 set emissions limits for the following products:

      • New spark-ignition engines used in outdoor power equipment such as lawn mowers, generators and whipper snippers
      • Marine vessels such as outboard engines, personal watercraft and stern-drive engines.

The Act requires that all new products are certified and labelled in accordance with the standards before they can be supplied to the Australian market. ‘Supply’ includes any offer to supply, including making available, displaying or advertising the product.

If you supply an emissions-controlled product, you will need to ensure it is:

      • Certified to a recognised international standard, as detailed in section 26 of the Rules, or Australian standards
      • Correctly labelled in accordance with section 39 of the Rules.

Sellers need to comply with any applicable laws and regulations. You can find important information about regulations concerning some of the hazardous materials mentioned in this this policy in the Australian National Security guidance for chemical security.

Human remains & body parts

We don’t allow the sale of human bodies, body parts, or products made from the human body on OZROLO.

      • Used funeral items like urns are not allowed
      • Human body parts or items containing body parts are not allowed, including first class relics.

International trading

Listing items for international sale can be a fun and rewarding experience and is one of the unique benefits of using OZROLO. At the same time, it’s important that all listings and transactions comply with applicable laws. Members are responsible for making sure their transactions are lawful in both the country of the seller and the country of the buyer.

If you’re posting worldwide, please be aware that your item may not appear in the search results in countries where the item is not allowed.

You can exclude countries you don’t want to post to by limiting your shipping zones.

Make sure your listings follow our guidelines. If they don’t, they may be removed, and your buying and selling privileges could be restricted.

Additional information for sellers

Items must comply with export laws

Make sure any items you’re selling can be lawfully sent outside of the country where you live. The export of certain items may require special licenses, or may be banned altogether.

Items encouraging illegal activity

Items or information that might enable or encourage illegal activity are not allowed. Examples include:

      • Kill switch-activated electronic devices, including smartphones and tablets
      • Items that can enable illegal activity, such as:
        • Pill presses
        • Blank rain checks
        • Selling USPS shipping materials
        • Products designed to fake the results of drug tests
      • Information on how to use or make illegal drugs, bombs, or explosives
      • Lockpicking tutorials

 

Knives

The following or similar types of knives are not allowed:

      • Automatic knives
      • Butterfly knives
      • Dual-action knives
      • Gravity knives
      • Star knives
      • Trench knives
      • Out-the-front knives
      • Paratrooper knives
      • Push knives
      • Switchblade knives
      • Sword canes
      • Spring-assisted knives
      • Hidden or disguised knives such as writing pen knives or belt buckle knives

Lock-picking devices

Lockpicking or locksmithing devices are not allowed. Some examples include:

      • Bump keys
      • Slim jims
      • Devices to make or duplicate keys
      • Devices designed to pick a lock
      • Code-grabbing devices

Lottery tickets

Listings that offer an opportunity to win an item by chance or contest are not allowed. This includes mystery items, giveaways, lotteries, sweepstakes, random drawings, raffles, and contests.

Mailing lists and personal information

We don’t allow the following to be sold on OZROLO:

      • Personal contact information such as phone numbers, email lists and addresses
      • Social security numbers or similar sensitive information
      • Accounts that require users to send passwords (for example, to sell access to the next level of social media games)
      • Social media items such as “accounts”, “likes”, “followers”, or “subscribers”
      • Software or tools used to send unsolicited contacts, such as text messages or email (spam), or to harvest contact details

Medicine, medical devices and healthcare products

Any medical device that requires a prescription can’t be sold on OZROLO. Items that aren’t allowed include:

      • Contact lenses (prescription or non-prescription)
      • Medical devices without a valid ARTG number
      • Medical devices which require a prescription
      • Items subject to recall by the Therapeutic Goods Administration or the Australian Competition and Consumer Commission
      • Needles, with or without a disposable syringe
      • Expired items
      • Nebulizers and their accessories

Listings for items that are allowed must meet the following requirements:

      • No used items are to be sold.
      • The item description should clearly state the product expiry date
        • Items must reach the buyer before the expiry date
      • Some medical devices can only be sold with government authorisation. Listings for these items must follow the rules below:
        • Items must be listed in the Industrial > Healthcare, Lab & Dental category

The following items can be sold:

      • Over-the-counter (OTC) medical devices
      • Vintage or collectable medical devices, but listings must state that these are not intended for use
      • New disposable syringes can be listed, but needles cannot be included.

Multi-level marketing, pyramid and matrix programs

Multi-level marketing, pyramid, and matric programs are often regulated, or illegal, and are not allowed to be listed or advertised on OZROLO.

Offensive material

Listings that promote, perpetuate or glorify hatred, violence, or discrimination, including on the grounds of race, ethnicity, color, religion, gender or sexual orientation, aren’t allowed. This includes but is not limited to the following:

      • Slurs or epithets of any kind
      • Slavery items, including reproductions, such as tags, shackles, documents, bills of sale, etc.
      • Items with racist, anti-Semitic, or otherwise demeaning portrayals, for example through caricatures or other exaggerated features, including figurines, cartoons, housewares, historical advertisements, and golliwogs
      • Black Americana items that are discriminatory
      • Confederate battle flag and related items with its image
      • Historical Holocaust-related and Nazi-related items, including reproductions
      • Any item that is anti-Semitic or any item from after 1933 that bears a swastika
      • Media identified as Nazi propaganda
      • Listings that imply or promote support of, membership in, or funding of a terrorist organization

Personal relationships and services

The following services are not allowed:

      • Personal relationships, including in-person or online relationships
      • Dating, sexual contact or escort services
      • Offer to become “friends” or “followers” on social media sites

Pesticides

Most hazardous materials are prohibited on OZROLO.

The following are not allowed:

      • Poisons and carcinogenic substances
      • Dinitrophenol (DNP) in any of its forms, either as a pure substance or active ingredient of any product (such as weight-loss supplements)
      • Fire extinguishers that contain carbon tetrachloride
      • Non-government-approved refrigerants
      • Radioactive materials
      • Combustible materials like black powder, caps for toy guns, explosive fuses, fireworks, exploding targets, flares, flash paper, red phosphorous, gasoline, Thermite
      • Explosives precursors including aluminium powder, ammonium nitrate, calcium ammonium nitrate, calcium nitrate, hydrogen peroxide above 12% weight by weight (carbamide peroxide above 34% by weight), magnesium nitrate hexahydrate, magnesium powder, nitric acid, nitromethane, nitro-fuel, potassium chlorate, potassium nitrate, potassium perchlorate, sodium azide, sodium chlorate, sodium nitrate, sodium perchlorate, sulphuric acid and urea nitrate
      • Hazardous materials banned by a selected delivery provider (Sellers should check with them before listing an item)

The following are restricted:

      • If the material can be sent by standard postage services and is not prohibited by local laws or regulations, then it can be listed
      • If hazardous materials have specific postage restrictions required by the delivery provider, these must be outlined in the item description

WELS Products

The Water Efficiency Labelling and Standards Act 2005 (WELS Act) is Australia’s water efficiency labelling scheme that requires certain products to be registered and labelled with their water efficiency in accordance with the standard set under this regulation.

The WELS Act requires that all new WELS products (such as showers, tap and toilet equipment, clothes washing machines and dishwashers) be supplied as they are registered, and the water efficiency information be displayed in the listing. See the Water Efficiency Labelling and Standards (WELS) scheme website for more details and to check registrations.

If you supply or sell WELS products, you need to ensure that the products:

      • Are registered with the WELS Regulator and the product has a correct WELS label in accordance with section 20 of the WELS Act; and
      • Have their labels or water rating information remain fully visible on or adjacent to products while they are offered for sale

In order to list WELS products on eBay, sellers must meet the requirements of the WELS Act.

GEMS Products

Australia’s Greenhouse and Energy Minimum Standards Act 2012 (GEMS Act) sets registration, minimum energy performance standards (MEPS) and energy labelling requirements for a range of appliances and equipment such as televisions, dishwashers, certain lighting products, three-phase electric motors and computers. The Energy Rating website contains a full list of regulated products and their specific requirements.

Under the GEMS Act, all models covered by the regulation must be registered prior to being supplied. Further information on the registration process is available on the Energy Rating website.

Products that do not meet these requirements cannot be supplied in Australia. Please note that the GEMS Act contains a range of penalties for non-compliance.

Additionally, some products – for example, some incandescent tungsten filament lamps (light bulbs) – are also covered by Customs import prohibitions and cannot be imported into Australia without written permission granted by the relevant Minister or an authorised officer.

GEMS products may be listed on eBay, provided they meet the requirements of the GEMS Act.

Some incandescent tungsten filament GLS lamps are subject to an import restriction. They must not be imported into Australia without written permission from the relevant Minister.

Emissions-controlled products

The Product Emissions Standards Act 2017 and the Product Emissions Standards Rules 2017 set emissions limits for the following products:

· New spark-ignition engines used in outdoor power equipment such as lawn mowers, generators and whipper snippers

· Marine vessels such as outboard engines, personal watercraft and stern-drive engines.

The Act requires that all new products are certified and labelled in accordance with the standards before they can be supplied to the Australian market. ‘Supply’ includes any offer to supply, including making available, displaying or advertising the product.

If you supply an emissions-controlled product, you will need to ensure it is:

· Certified to a recognised international standard, as detailed in section 26 of the Rules, or Australian standards

· Correctly labelled in accordance with section 39 of the Rules.

Plants and seeds

Endangered plants are not allowed

For all other plants or seeds, sellers should check with the following resources to determine if an item is restricted or prohibited:

        • Biosecurity Import Condition system (BICON)
        • Department of Agriculture and Water Resources

Importing seeds – Seeds can generally only be sent to Australia if the Australian Government’s Biosecurity Import Conditions system (BICON) indicates they are permitted and are not otherwise restricted from being imported into Australia. Sellers should check this list before supplying seeds to buyers in Australia.

If the seeds require an import permit from the Department of Agriculture and Water Resources, sellers must sight a copy of the permit to ensure that they can meet the conditions for sending seeds to Australia, and include a copy of the permit in the consignment.

Importing plants – Live plant material must not be sent to Australia unless the buyer has a valid import permit issued by the Department of Agriculture and Water Resources. Sellers must sight a copy of the permit to ensure that they can meet the conditions for importing live plants to Australia and include a copy of the permit in the consignment. Domestic sales of plants and seeds – Plants and plant products can be listed for sale within Australia only if they can legally enter the state or territory without restriction. For more information, refer to the Quarantine Domestic website.

Additional information

Live plants and seeds detected by the Department of Agriculture and Water Resources that are not permitted will be confiscated and destroyed. Mail entry points into Australia (including air courier) are monitored by X-rays, detector dogs and manual inspection of mail articles.

Additional information on the import conditions surrounding live plants (nursery stock) and seeds and applying for an import permit can be found by searching by species name on the Department of Agriculture and Water Resources Biosecurity Import Condition system (BICON).

Police-related items

The following items can’t be listed for sale on OZROLO:

      • Law enforcement and other government-issued uniforms, badges, or accessories, such as hats, jackets, or shirts,or replicas of these items
      • Official emergency lighting systems or sirens, including lenses or LEDs for these systems

Additional information

Emergency services and law enforcement agencies generally prohibit any commercial reproduction of their name, seal, or logo. Copies or reproductions of military, emergency services or law enforcement emblems infringe upon the copyright and trademark rights of the agency that owns the emblem and such items may be ended.

Use of Defence Emblems

It is an offence under the Defence Act 1903 for a person to make, supply or offer to supply a defence emblem without the written authority of the Minister of Defence or a person as authorised in writing by the minister. Any listing of a Defence emblems must clearly show this written authority. Please note that the unauthorised copying of a Defence emblem may also constitute a breach of the Commonwealth of Australia’s copyright over a particular work.

Postage meters

Most vintage clothing or uniforms from commercial airlines, transit, or postal companies – including accessories like bags, hats and ties – can be listed, as long as the seller meets all of the following conditions:

      • The item is 10 years old or older
      • It’s no longer used by any airline, postal carrier, transportation company or entity operating subways, trains, or buses
      • It doesn’t look like current uniforms or accessories

If your vintage uniform doesn’t meet all those requirements you won’t be able to list it.

Prescription drugs

Any medical device that requires a prescription can’t be sold on eBay. Items that aren’t allowed include:

      • Contact lenses (prescription or non-prescription)
      • Medical devices without a valid ARTG number
      • Medical devices which require a prescription
      • Items subject to recall by the Therapeutic Goods Administration or the Australian Competition and Consumer Commission
      • Needles, with or without a disposable syringe
      • Expired items
      • Nebulizers and their accessories

Listings for items that are allowed must meet the following requirements:

      • Listings must state in the item description if the device has been opened or used:
        • Used items must be properly cleaned
        • Used items must not be altered in any way that changes the performance or safety specifications of the device
      • The item description should clearly state the product expiry date
        • Items must reach the buyer before the expiry date
      • Some medical devices can only be sold with government authorisation. Listings for these items must follow the rules below:
        • Items must be listed in the Industrial > Healthcare, Lab & Dental category

The following items can be sold:

      • Over-the-counter (OTC) medical devices
      • Vintage or collectable medical devices, but listings must state that these are not intended for use
      • New disposable syringes can be listed, but needles cannot be included

Real estate

OZROLO does not permit the sale/rental of property on its website.

Recalled items

The following types of items are not allowed:

      • Products recalled by a manufacturer or another government agency.
      • Products where the sale of the product is prohibited by law or regulation, including products failing to comply with Australian mandatory safety standards or which are subject to a product ban in Australia.
      • Products that pose a health or safety hazard as specified by government agencies.
      • Current information can be found on the US Consumer Product Safety Commission website, the EU Safety Gate: Rapid Alert System website and the OECD Global Recalls portal.
      • Handheld lasers with an output of more than 1 milliwatt (mW)

Sellers can list the following types of items:

      • Items subject to a recall but not prohibited by law, as long as the listing includes the recall information
      • Items complying with these safety standards:
        • (Permitted) lighters may only be listed if they are equipped with a child-resistant mechanism
        • Hoverboards, self-balancing scooters and components or parts such as batteries and chargers must comply with Consumers Goods Safety Standard 2018 that sets out safety requirements. Self-balancing scooters must be certified to meet the UL 2272 safety standards. Sellers must state in the listing that the item is UL 2272 certified by including a link to the UL Online Certifications Directory showing the certification, and can only offer postage to USA, Canada and Australia
        • Used car seats are not allowed.
        • Other baby and nursery products meeting Australian mandatory safety standards.
        • If the product you are selling includes an adaptor, please ensure that the adaptor is permanently affixed and cannot be removed without the use of tools. Please familiarise yourself with the plugs and sockets regulation

Stamps

OZROLO does not allow the trading of raw or graded currency.

Stocks and other securities

The sale of stocks and other security interests is regulated and, as such, they can’t be sold on OZROLO.

Stolen property

The sale of stolen property is not allowed on OZROLO.

Surveillance equipment

The following types of electronic equipment are not allowed:

      • Radar detectors
      • American FRS/GMRS radio equipment
      • CB Amplifiers
      • Cell phone, GPS radar and other signal jamming devices
      • Telecommunications numbers
      • Mobile Phone unlocking codes

Cameras, recorders, or other similar devices can be listed as long as the description doesn’t encourage their use for illegal purposes.

The following items may only be sold in accordance with applicable regulations:

      • Scanners
      • Transmitters
      • CB radios
      • Amateur radio equipment
      • Low interference potential devices
      • Telecommunication products
      • Mobile phone repeaters
      • Mobile phone booster amplifiers
      • High powered cordless phones

Tobacco

The following or similar items are not allowed:

      • Cigarettes, cigars, and loose tobacco
      • Cigarette papers and cigarette rollers
      • Herbal cigarettes or herbal tobacco (sometimes called nicotine-free or tobacco-free cigarettes or shisha)
      • Waterpipes, bongs and vaporisers
      • Electronic nicotine delivery systems (ENDS) including e-cigarettes, e-liquids and e-cigarette parts
      • Accessories for e-cigarettes

Travel

OZROLO does not allow buying and selling travel services or holiday packages.

Vouchers

OZROLO does not allow the sale of vouchers.

Activities that doesn’t follow OZROLO policy could result in a range of actions including for example: administratively ending or canceling listings, hiding or demoting all listings from search results, lowering seller rating, buying or selling restrictions, and account suspension.
